1. Acceptance of these terms

Welcome to Kachy. These Terms of Service (the "Terms") govern your access to and use of Kachy's websites, applications, and services (together, the "Service"), operated by [Legal entity name] ("Kachy", "we", "us", or "our").

By creating an account, signing in, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Who can use Kachy

You must be at least 18 years old and able to form a binding contract to use the Service. By using Kachy, you represent that you meet these requirements and that the information you provide is accurate and complete.

3. What Kachy does

Kachy is an agentic shopping service. You give Kachy a purchase mandate, Kachy searches available supply paths, and Kachy may present an executable offer for your approval.

Supply may come from third-party marketplaces, commerce partners, boutiques, Kachy-operated inventory, or individual providers. The merchant of record, checkout operator, and applicable protection terms may vary by execution path and will be disclosed before purchase.

4. Your account and sign-in

You sign in with your email address using a one-time code, so there is no password to remember. As part of your account, a wallet may be provisioned on your behalf to enable secure payments.

You are responsible for keeping access to your email and account secure, and for all activity that happens under your account. Please notify us promptly if you believe your account has been compromised.

5. Orders, payments, and protection

For a Kachy Escrow execution, your payment is held securely and is not released to the designated payout recipient until you confirm delivery or the disclosed confirmation window closes. Partner checkout executions follow the partner's payment and protection terms.

After delivery on a Kachy Escrow execution, you have a 3-day window to confirm receipt or report a problem. If you take no action, settlement may occur automatically.

If Kachy cannot complete an escrowed execution, or an order is cancelled before fulfillment, the amount held is refundable under the applicable execution terms. Fees are disclosed before you accept an offer.

6. Items and supply providers

Item information may originate from marketplaces, commerce partners, boutiques, inventory operators, or other supply providers. Availability and item details can change before execution.

You are responsible for reviewing item details, including size, condition, and price, before confirming a purchase.

7. Shared requests on Discover

You may choose to share an anonymous summary of a purchase request on Discover. Web requests are set to share by default, and you can turn sharing off before submission or withdraw the request later. MCP and API requests are shared only when sharing is explicitly requested.

Other users may save a shared request or use it as the starting point for their own BuyerMandate. Product size and approved conditions may appear with the anonymous request, but another user must provide their own size and delivery details when creating a mandate. Their mandate is separate from yours and does not include your delivery destination or identity. You must not include contact details, addresses, account names, links, prohibited products, or other sensitive information in content intended for public sharing.

8. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose, or to buy or sell prohibited, counterfeit, or stolen goods.
• Misrepresent your identity or provide false information.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
• Use automated means to scrape, copy, or overload the Service except as expressly permitted.
• Infringe the intellectual property or other rights of Kachy or any third party.

9. Intellectual property

The Service, including its software, design, text, and branding, is owned by Kachy or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, or create derivative works except as allowed by law.

10. Third-party services

The Service relies on third-party providers, including wallet, payment, identity-verification, marketplace, and commerce partners. Your use of those services may be subject to their own terms and policies. Kachy is not responsible for third-party services.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Kachy does not warrant that the Service will be uninterrupted, secure, or error-free.

12. Limitation of liability

To the fullest extent permitted by law, Kachy and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to Kachy for the order giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Kachy and its partners from any claims, damages, losses, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

14. Suspension and termination

We may suspend or terminate your access to the Service at any time if you violate these Terms, create risk for Kachy or others, or where required by law. You may stop using the Service at any time.

15. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

16. Governing law
